The terms that govern your use of OnlineProShops as a buyer.
These terms form a legally binding agreement. By using OnlineProShops you accept them. We may update these terms; the current version is always on this page. If you do not agree, do not use the platform.
OnlineProShops provides a platform for you to browse and buy golf equipment from independent UK Pro Shops. We do not own the stock and are not the seller of record. The contract for the sale of goods is between you and the Pro Shop that lists the item. We facilitate the transaction, collect payment on the Pro Shop's behalf, and support both parties.
When you place an order and complete payment, you are making an offer to the Pro Shop. The contract is formed when your payment has been successfully processed and the order is confirmed. Until that point, no contract exists and the Pro Shop is not obliged to supply the goods. You are responsible for providing accurate contact and delivery information at checkout.
Pro Shops selling through OnlineProShops must comply with your statutory rights, including the 14-day right to cancel (change of mind) under the Consumer Contracts Regulations 2013 and your rights when goods are faulty or not as described under the Consumer Rights Act 2015. Pro Shops who sell on OnlineProShops are subject to separate seller terms and conditions, which we provide to them when they join the platform and in the seller dashboard. This page does not set out those seller terms.
We do not allow the sale of counterfeit equipment, non-golf-related items (unless expressly permitted), or any item whose sale would breach applicable law. You must not use the platform to circumvent it (e.g. arranging to pay a seller off-platform). We reserve the right to suspend or terminate accounts that breach these rules.
To the extent permitted by law:
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your statutory rights are not affected.
We reserve the right to suspend or terminate any account that violates these terms, engages in fraud or abusive behaviour, or attempts to bypass the platform. We may also suspend or terminate accounts for operational or legal reasons. Where reasonably possible, we will give notice and an opportunity to remedy before permanent termination, except where immediate action is necessary (e.g. fraud or safety).
These terms are governed by the laws of Scotland. Any dispute arising in connection with these terms or the platform shall be subject to the exclusive jurisdiction of the courts of Scotland, except where you are a consumer and the law of your country of residence gives you the right to bring proceedings in your local courts.
