Terms & Conditions

The terms that govern your use of OnlineProShops as a buyer.

These terms form a legally binding agreement. By using OnlineProShops you accept them. We may update these terms; the current version is always on this page. If you do not agree, do not use the platform.

1. Terms for the buyer (the golfer)

1.1 The marketplace service

OnlineProShops provides a platform for you to browse and buy golf equipment from independent UK Pro Shops. We do not own the stock and are not the seller of record. The contract for the sale of goods is between you and the Pro Shop that lists the item. We facilitate the transaction, collect payment on the Pro Shop's behalf, and support both parties.

1.2 Formation of contract

When you place an order and complete payment, you are making an offer to the Pro Shop. The contract is formed when your payment has been successfully processed and the order is confirmed. Until that point, no contract exists and the Pro Shop is not obliged to supply the goods. You are responsible for providing accurate contact and delivery information at checkout.

1.3 Pricing and payments

  • Prices are set by the Pro Shops and displayed in GBP.
  • We collect payment on behalf of the Pro Shop via Stripe. Your payment (including shipping) is processed at checkout. Stripe's terms and privacy policy apply to the payment process.
  • You are responsible for any import duties, taxes or customs charges if you order from a Pro Shop and have the goods delivered outside the United Kingdom.

1.4 Returns and refunds

Pro Shops selling through OnlineProShops must comply with your statutory rights, including the 14-day right to cancel (change of mind) under the Consumer Contracts Regulations 2013 and your rights when goods are faulty or not as described under the Consumer Rights Act 2015.   • To initiate a return, contact us via the contact page with your order number and the item you wish to return. We will connect you with the Pro Shop to obtain the return address and process the return.
  • For a change-of-mind return, items must be in original, unused condition (e.g. plastic on clubheads where applicable, tags on clothing). Unless the item is faulty, you are responsible for the cost of return postage.

Pro Shops who sell on OnlineProShops are subject to separate seller terms and conditions, which we provide to them when they join the platform and in the seller dashboard. This page does not set out those seller terms.

2. General marketplace rules

2.1 Prohibited items and conduct

We do not allow the sale of counterfeit equipment, non-golf-related items (unless expressly permitted), or any item whose sale would breach applicable law. You must not use the platform to circumvent it (e.g. arranging to pay a seller off-platform). We reserve the right to suspend or terminate accounts that breach these rules.

2.2 Limitation of liability

To the extent permitted by law:

  • OnlineProShops is not liable for the quality, safety, fitness for purpose or description of goods sold by Pro Shops. The contract is between the buyer and the Pro Shop; the Pro Shop is responsible for the goods.
  • We are not liable for any loss of profit, revenue, goodwill, or any indirect or consequential loss arising from your use of the platform or from any transaction.
  • We are not liable for platform downtime, technical failures or third-party services (e.g. payment or hosting) except where we have been negligent and such liability cannot be excluded by law.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your statutory rights are not affected.

2.3 Termination and suspension

We reserve the right to suspend or terminate any account that violates these terms, engages in fraud or abusive behaviour, or attempts to bypass the platform. We may also suspend or terminate accounts for operational or legal reasons. Where reasonably possible, we will give notice and an opportunity to remedy before permanent termination, except where immediate action is necessary (e.g. fraud or safety).

2.4 Governing law and jurisdiction

These terms are governed by the laws of Scotland. Any dispute arising in connection with these terms or the platform shall be subject to the exclusive jurisdiction of the courts of Scotland, except where you are a consumer and the law of your country of residence gives you the right to bring proceedings in your local courts.

2.5 Contact and changes

For questions about these terms, please contact us using the details on our contact page. We may update these terms from time to time; the "Last updated" date at the top will be revised. Continued use of the platform after changes constitutes acceptance of the updated terms. These terms take precedence over any other summary or description of how the marketplace works (e.g. on other pages of the site) to the extent of any conflict.
